Article 1
Scope of application and entity operating on the portal
These terms govern bookings made through AmalfiCoastLovers.com, a portal managed by VISTA – Travel Signature, the commercial name of 3DICI STUDIO di Fabio Olivieri, Travel Agency and Tour Operator.
Depending on the service purchased, VISTA – Travel Signature may operate as organizer, seller or intermediary. The role assumed, any third-party provider who physically performs the service and the specific applicable conditions result from the offer sheet, the summary before purchase, the voucher or the booking confirmation.
These terms supplement the information of the individual offer. If a specific condition, communicated and accepted before purchase, is different from the general rule, the specific condition for that service prevails. No clause can limit the mandatory rights recognized by law to the consumer or the traveler.
Article 2
Booking request and confirmation
- Choice of service. The customer selects the date, time, number and type of participants and any available options.
- Verification of data. Before payment, the customer checks the program, meeting point, requirements, inclusions, exclusions, price and specific conditions.
- Payment or request. Sending a request does not guarantee availability when the sheet indicates that manual confirmation is required.
- Confirmation. The booking is concluded when the customer receives the confirmation or the voucher, unless otherwise explicitly indicated during the purchase process.
Whoever makes the booking declares to be of legal age, to have the capacity to conclude the contract and, when booking for other people, to be authorized to communicate their data and to accept the conditions also on their behalf.
Names, contact details, age, documents and any other requested information must be complete and correct. Costs, impossibility of participation or disservices caused by incorrect or incomplete data remain the responsibility of the customer, except for cases attributable to the agency or the service provider.
Article 3
Prices, payments and travel documents
The total price, taxes and any known mandatory costs are shown before the order is sent. Optional services, supplements requested subsequently, expenses incurred on site and items expressly indicated as excluded are not included.
Payment is made using the tools available in the booking process. In case of unauthorized, refused, revoked or incomplete payment, the booking may not be confirmed or may be cancelled following communication to the customer.
The customer must keep the confirmation, the voucher and any access tickets and present them in the format indicated. It is their responsibility to promptly verify the data reported and report any errors without delay.
Article 4
Right of withdrawal for services on a pre-established date
The 14-day right of withdrawal provided for some distance contracts does not apply, in the cases provided for by Article 59, paragraph 1, letter n), of the Consumer Code, to services related to leisure activities when the contract provides for a specific date or period of execution. The same provision also contemplates some other categories of services on a specific date.
Any exclusion of the 14-day withdrawal does not eliminate the contractual cancellation rights described on this page, the more favorable conditions of the individual offer nor the mandatory protections provided for tourist packages or for other types of contract.
Regulatory reference: Article 59 of the Consumer Code.
Article 5
Cancellation requested by the customer
Except for specific conditions communicated before purchase and except for the rights provided by law, the following rules apply to voluntary cancellations by the customer:
| When we receive the cancellation | Refund | Retention |
|---|---|---|
| At least 20 days before | 100% of the amount paid | 0% |
| From less than 20 up to at least 10 days before | 70% of the amount paid | 30% |
| Less than 10 days before | 0% | 100% |
| No-show or cancellation after the start | 0% | 100% |
How the notice period is calculated
The term is calculated backwards from the time scheduled for the start of the service, according to the Europe/Rome time zone: 20 days correspond to 480 hours and 10 days to 240 hours. The moment in which the written request is received through the booking channel or at the e-mail address indicated in Article 13 below shall prevail.
If the booking is made when there are less than 10 days left until the start of the service, it is normally non-refundable, unless otherwise shown before payment, cancellation due to bad weather pursuant to Article 8 or mandatory right provided by law.
Services with specific conditions
Entrance tickets, transport tickets, carrier fares, personalized services, rentals, charters, boats, private guides and third-party services may have different rules, more restrictive limits or non-refundable rates. Such conditions are valid only if made available clearly before the conclusion of the booking.
Article 6
Changes requested by the customer
Requests for change of date, time, name, number of participants, starting point or service are subject to availability, the rules of the provider and any price difference. The request produces no effect until it is confirmed in writing.
When the change cannot be accepted and the customer gives up the original service, the request is treated as a cancellation and the conditions of Article 5 apply. Any free changes or more favorable conditions will be indicated in the individual offer.
Article 7
Punctuality, requirements and no-show
The customer must present themselves at the place indicated, with the required advance notice and with documents, clothing, authorizations and requirements specified. Delays, no-shows, invalid documents or failure to comply with the requirements may result in the impossibility of using the service without the right to a refund, except for the responsibility of the agency or the provider and subject to mandatory legal rights.
The customer must communicate accessibility needs, relevant medical conditions or other special needs before booking so that it is possible to verify the suitability and the concrete availability of the requested service.
Article 8
Adverse weather conditions
If the service is cancelled
If, before the start, the agency, the provider, the captain of the boat or the competent authority cancels the service because the weather or sea conditions do not allow it to be carried out safely, the customer can choose between:
- 100% refund of the amount paid for the cancelled service;
- date change without penalties, subject to availability.
If the service remains operational
Personal weather forecasts, light rain, cloudiness or conditions considered safe by the operator do not automatically entitle to a refund. If the customer decides not to participate while the service is confirmed, the rules of Article 5 apply.
For nautical services, the operational decision rests with the captain, the provider and/or the competent authorities. For land services, the mere presence of rain does not necessarily determine cancellation. Any itinerary variations adopted for safety will be communicated as soon as possible; if they substantially affect the essential characteristics of the service, the protections provided by the contract and the law apply.
If the service is interrupted after the start, any alternative or refund is evaluated based on the part not performed, the cause of the interruption, the conditions of the individual offer and the applicable mandatory rules.
Article 9
Cancellation or modification by the agency or the provider
If the service is cancelled before the start due to unavailability, operational reasons, safety, authority measures or other causes not attributable to the customer, an alternative date or an equivalent performance is proposed, when possible. If the customer does not accept the alternative, they receive a full refund of the amount paid for the cancelled service, unless a different mandatory regulation applies to the specific case.
Significant changes to times, itinerary, starting point or essential characteristics are communicated without unjustified delay to the contact details provided. The specific protections provided for tourist packages and the responsibilities provided by law remain unaffected.
Article 10
Inevitable and extraordinary circumstances
Events such as measures by the authorities, closures of ports or sites, severe weather conditions, disasters, health emergencies, riots or other circumstances beyond the reasonable control of the parties are managed according to the nature of the service, the conditions communicated before purchase and the applicable legislation.
When the booking constitutes a tourist package, the traveler retains in particular the rights recognized by the regulation on packages, including the possibility to withdraw without costs under the conditions established by law.
Article 11
Specific conditions for tourist packages
If the combination purchased constitutes a tourist package pursuant to the Tourism Code, the relative mandatory regulation prevails. Before the conclusion of the contract, the information and specific conditions required by law will be provided.
The traveler may withdraw before the start of the package by paying appropriate and justifiable withdrawal fees or the reasonable standard fees provided for by the contract. In the presence, at the place of destination or in the immediate vicinity, of inevitable and extraordinary circumstances that substantially affect the execution of the package or transport to the destination, if the legal requirements are met, they may withdraw without costs and obtain a full refund, without additional compensation.
Refunds due for withdrawal from a package are made without unjustified delay and, in the cases provided for by Article 41 of the Tourism Code, within 14 days of withdrawal.
Regulatory reference: Article 41 of the Tourism Code.
Article 12
Methods and timing of refunds
The refund is arranged, as a rule, on the same instrument used for payment. If this is not technically possible, a suitable and safe alternative method will be agreed upon. A voucher is not imposed in place of a due refund, unless the customer consents or there is a different mandatory provision of law.
Refunds recognized under these terms are arranged without unjustified delay and normally within 14 days of written confirmation of the right to a refund. The time in which the amount becomes visible also depends on the payment circuit and the customer’s institution.
Article 13
How to request cancellation, modification or assistance
The request must be sent in writing through the same channel used to book or via e-mail, indicating at least the booking number, name of the holder, service, date and desired request. A request sent only to the provider does not replace communication to the agency or the platform through which the purchase was concluded.
For bookings concluded through a third-party platform, the customer must also use the cancellation procedure provided by the platform, so that the request is registered correctly and can be processed within the applicable times.
Article 14
Responsibility and reporting of problems
VISTA – Travel Signature is liable within the limits of the role assumed in the individual booking and according to the applicable legislation. Third-party providers are liable for the execution of the activities entrusted to them according to the law and the contract. No provision of these terms excludes or limits liability that cannot be excluded or limited by law.
The customer must report any defects, disservices or non-conformities found during execution without unjustified delay, so as to allow, when possible, timely intervention. Subsequent complaints must report the booking data, the description of the facts and any useful documentation.
Article 15
Applicable law, disputes and updates
These terms are governed by Italian law. For the consumer, the court of the place of residence or domicile remains competent in the cases provided for by the applicable legislation. The alternative dispute resolution tools provided by law remain available, without prejudice to the right to appeal to the competent judicial authority.
Changes to these terms apply to bookings concluded after their publication, unless the law or a change expressly more favorable to the customer provides otherwise. The version accepted at the time of the conclusion of the contract applies to the individual booking, which the customer is invited to keep together with the confirmation.
